Het strafrechtelijk onderzoek begon afgelopen februari toen het Nationaal Archief een doorverwijzing naar het ministerie van Justitie uitvaardigde na ontdekking van meer dan 100 geheime documenten vermengd met presidentiële documenten in 15 dozen die Trump had teruggestuurd.

Toen het ministerie van Justitie de geheime documenten bekeek, zeiden mensen die bekend waren met het onderzoek, waren topambtenaren van de nationale veiligheidsafdeling gealarmeerd toen ze ontdekten dat sommige materialen neerkwamen op informatie over de nationale defensie die wordt gecontroleerd door de spionagewet.

Het probleem was het enorme volume en de gevoeligheid van geclassificeerd materiaal in de dozen. Volgens een schatting die destijds aan de advocaten van Trump werd verstrekt, bevatten de 15 dozen meer dan 100 documenten – meer dan 700 pagina’s – die de nationale veiligheid in gevaar konden brengen.

De ontdekking vormde een probleem voor de afdeling omdat Trump niet langer bevoegd was om dergelijke documenten te bewaren nadat hij zijn ambt had verlaten en functionarissen begonnen zich zorgen te maken dat Trump in het bezit zou kunnen zijn van nog meer geheime documenten die ook materiaal voor de nationale veiligheid waren.

Het spionageonderzoek was gericht op de vraag of Trump pronkte met materiaal voor de nationale veiligheid in zijn kantoor in Mar-a-Lago, en heeft meerdere getuigen ondervraagd over de vraag of Trump zwaaide met geheime documenten die hij had bewaard toen hij daar niet langer toestemming voor had nadat hij zijn ambt had verlaten.

Aanklagers hebben ook getuigen gevraagd naar documenten over mogelijke Amerikaanse militaire actie tegen Iran, nadat Trump naar een dergelijk document verwees tijdens een vergadering in Bedminster in juli 2021, waar hij zei dat hij een bepaald document niet kon tonen omdat hij het niet vrijgaf als president.

Daartoe hebben aanklagers een Iran-document getoond aan enkele getuigen die voor de grand jury van Washington verschenen en vroegen of ze het materiaal ooit door Trump of iemand anders hadden gezien. Het was niet duidelijk of een getuige bevestigde het document te hebben gezien, zei een van de mensen.

Het onderzoek naar de obstructie heeft zich ondertussen gericht op de vraag of het feit dat Trump vorig jaar niet volledig aan de dagvaarding voldeed, een opzettelijke daad van obstructie was, omdat hij de geheime documenten wilde behouden, zelfs nadat hij zijn ambt had verlaten, zeiden de mensen.

Afgelopen juni vond de sindsdien afgewezen Trump-advocaat Evan Corcoran 38 geheime documenten in de opslagruimte van Mar-a-Lago en vertelde het ministerie van Justitie dat daar geen materiaal meer achterbleef – wat in twijfel kwam toen de FBI maandenlang nog eens 101 geheime documenten in beslag nam later.

Corcoran vertelde later aan medewerkers dat hij zich misleid voelde omdat hij had gevraagd of hij ergens anders in Mar-a-Lago moest zoeken, zoals het kantoor van Trump, maar werd weggestuurd, meldde de Guardian voor het eerst. Uit de aantekeningen van Corcoran bleek ook dat hij tegen Trump had gezegd dat hij alle geheime documenten in zijn bezit moest teruggeven.

Het ministerie van Justitie had donderdag een drukke dag. Terwijl ze Donald Trump strafrechtelijk aanklaagden onder de Spionage Act, klaagden ze ook afzonderlijk iemand aan die dicht bij een van de bondgenoten van Trump stond.

Volgens de Wall Street Journal heeft het Ministerie van Justitie een Texaanse man genaamd Nate Paul aangeklaagd en gearresteerd. Waarom is dit relevant? De Republikeinen van Texas hebben net de procureur-generaal van hun staat, Ken Paxton, aangeklaagd en verwijderd, nadat ze Paxton ervan beschuldigden dat hij zijn ambt op corrupte wijze had gebruikt om Paul te verrijken.

Dit kan verklaren waarom de Texaanse Republikeinen plotseling zo'n haast hadden om Paxton de achterdeur uit te schuiven. Nu Paxton's vermeende mede-samenzweerder aangeklaagd is, zou je denken dat Paxton de volgende is die aangeklaagd wordt. Paxton wordt immers al lange tijd strafrechtelijk onderzocht door de federale overheid en de staat, en nu lijkt het een crescendo te naderen.

Er is geen reden om aan te nemen dat de aanklacht van het DOJ tegen Donald Trump en de aanklacht van het DOJ tegen Ken Paxton's bondgenoot op dezelfde dag iets anders is dan toeval. Maar het wijst er wel op dat een aantal van deze langlopende federale strafrechtelijke onderzoeken naar de wereld van Trump nu hun vruchten afwerpen.

Wat betreft de door Trump meegenomen documenten, heb ik al heel lang niets meer vernomen over de shortlist met voor de Amerikanen belangrijke spionnen die Trump eens zou hebben opgevraagd bij de CIA. Er was ook een verhaal over spionnen die relatief vaker werden ontmaskerd maar dat speelde daarvoor al.

In MSNBC's "Way Too Early" met gastheer Jonathan Lemire, prees een zichtbaar tevreden Palm Beach State Attorney Dave Aronberg special counsel Jack Smith voor het verplaatsen van de 7 aanklachten tegen Donald Trump naar Florida in plaats van Washington D.C., en noemde het een "gangster move".

In een gesprek met de presentator beweerde de aanklager dat niemand de aanklachten van een grote jury in Florida had zien aankomen en hij prees de DOJ voor het tot het laatste moment verborgen houden ervan.

Zoals Aronberg uitlegde, door de aanklachten in Florida in te dienen, voorkwam Smith dat de advocaten van Trump de zaak zouden traineren door te pleiten voor een verandering van locatie door te zeggen dat ze geen eerlijk proces konden krijgen in de hoofdstad, waar de voormalige president erg impopulair is.

"Weet je, in Washington D.C. stemde 92% voor Joe Biden tegen 5% voor Donald Trump in 2020," vertelde hij de presentator. "In Palm Beach County stemden ze 43% voor Donald Trump en Miami-Dade County stemden ze 46% voor Donald Trump, dus je kunt zien waarom de jurypool beter is voor aanklagers in D.C."

"Aanklagers moeten aanklachten indienen tegen verdachten in het rechtsgebied waar de misdaad plaatsvond," vervolgde hij. "Het lijkt erop dat de obstructie duidelijk plaatsvond in Mar-a-Lago in het zuidelijke district van Florida, evenals de spionage. En het indienen van de zaak in Zuid-Florida elimineert de onvermijdelijke locatie-uitdagingen van Trump in de rechtbank -- dat had de zaak ongedaan kunnen maken, het zou de zaak hebben vertraagd."

- Merrick Garland, Jack Smith en de DOJ hebben nog geen commentaar gegeven.
- Hij zal worden aangeklaagd voor 7 aanklachten, waaronder het overtreden van de spionagewet, obstructie, het afleggen van valse verklaringen, samenzwering en waarschijnlijk geknoei met getuigen.
- Trump zal dinsdag om 15.00 uur ET voor de rechtbank verschijnen volgens advocaat Jim Trusty (zie hieronder).
- De aanklacht is ingediend bij de Federale Rechtbank in Miami.
- Dit is de eerste keer in de geschiedenis dat een voormalig president federaal is aangeklaagd voor een misdrijf.
- Wat interessant is, is dat Miami een zeer neutrale locatie is (gestemd op Biden 53% - 46% in 2020), dus het argument van Trump dat hij geen eerlijk proces kan krijgen, zal hier niet veel steek houden.
- Het is mogelijk dat Trump wordt gevraagd om een ??DNA-monster en vingerafdrukken te verstrekken bij voorgeleiding.
- Het is niet bekend hoe snel we een proces zullen zien, maar Trump zal ongetwijfeld proberen het proces door te zetten tot na de verkiezingen, terwijl Jack Smith waarschijnlijk zal proberen het proces af te ronden voordat de GOP-voorverkiezingen eindigen. Het zal aan de rechter zijn om te beslissen.

Twaalf uur nadat werd aangekondigd dat Donald Trump door een grand jury in Florida is aangeklaagd voor zeven aanklachten, waaronder belemmering van de rechtsgang, samenzwering en schendingen van de spionagewet, verklaarde Joe Scarborough van MSNBC dat de voormalige president niemand anders de schuld kan geven dan hijzelf, aangezien hij jaren tegemoet gaat. in de gevangenis als hij wordt veroordeeld.

Fresh off the news that Donald Trump is being indicted on several felonies related to possessing classified government documents, CNN reports this morning that an audio recording has emerged of him bragging about keeping a “secret” military document that had not been declassified.

“As president, I could have declassified, but now I can’t,” Trump says, according to a transcript of the recording that CNN obtained. The network reports that the audio recording captures the sound of paper rustling, indicating that Trump may have actually been waving the document around as he was talking about it.

“Secret. This is secret information. Look, look at this,” Trump says in the transcript. “This was done by the military and given to me.” Prosecutors have this recording, CNN says.

A federal judge appointed by Donald Trump who last year drew scrutiny for a ruling that was seen as differential to the former president may oversee proceedings in the case over his possession of classified documents, a source familiar with the summons told the Guardian.

US district judge Aileen Cannon has been listed on the summons sent to Trump’s lawyers, the source said. You may remember the Florida-based juror’s name from last year, when she granted a request from Trump’s attorneys to appoint a special master to review the records federal agents seized from Trump’s Mar-a-Lago resort in August.

Rechter Jonathan Swift van het Hooggerechtshof zei dat een nieuw beroep eenvoudigweg de argumenten zou "herhalen" die de advocaten van Assange al hadden aangevoerd en verloren.

Assange vecht al jaren voor Britse rechtbanken om te voorkomen dat hij naar de VS wordt gestuurd, waar hij wordt geconfronteerd met 17 aanklachten wegens spionage en één aanklacht wegens computermisbruik na de publicatie door WikiLeaks van geheime diplomatieke en militaire documenten meer dan tien jaar geleden.

An aide to Donald Trump, Walt Nauta, has been indicted alongside the former president in special counsel Jack Smith’s investigation into the mishandling of classified documents, according to several reports.

Trump has also posted about the news on Truth Social. He said:

Worries over electability pierce united GOP front on Trump indictment
Party activists gathered in Georgia react to former president’s latest legal woes with unflinching support but some doubts about his chances to win back the White House

COLUMBUS, Ga. — Laurie Wood was in the hotel elevator when she saw the text alert on her phone: Donald Trump had been indicted. “Here we go again,” she thought.

In town as a first-time delegate to the Georgia GOP convention here, Wood stepped out onto a terrace for a cigar party grateful to be spending this historic night with fellow conservatives. State committee members gathered amid the smoke and mosquitoes were already anticipating Trump’s speech to the convention on Saturday, and now many were just finding out and beginning to reckon with the latest political earthquake.

“Game on,” said John Fredericks, a pro-Trump talk radio host popular in Georgia and Virginia, when a reporter read him Trump’s social media posts announcing the charges. “Indict away. Every indictment we get more emboldened, we get stronger, we get more votes, because working people in this country are on to their game. Trump will be the nominee, and he will win an overwhelming victory regardless of the number of witch-hunt indictments that the communists and the liberals try to push on him.”

The cigar party’s host, Republican National Committee member Jason Thompson, was quick to dismiss the indictment, which remains sealed but is said to arise from Trump’s handling of classified materials after leaving the White House. “Honestly that’s probably the weakest case — I’m a lawyer, I would know,” Thompson said between puffs. “All the presidents take documents with them, and they’re trying to make something out of it because it’s Trump.”

But even as many of the Trump fans in attendance attacked the case as politically motivated, predicted it would strengthen Trump’s support and changed the subject to accusations against President Biden, some acknowledged that Trump’s mounting legal challenges — an earlier indictment in New York, where Trump plead not guilty to felony counts related to payments intended to silence an adult-film actress during his 2016 campaign, and ongoing federal and state probes into his efforts to overturn the 2020 election — could weaken his candidacy in the general election.

“We don’t know what’s next with Trump,” said Randy Pittman, a welder and a member of the state GOP committee from Walker County, in Northwest Georgia, who voted for Trump twice and liked many of the policies he implemented as president. Pittman said he doesn’t think Trump attracts votes from across the political spectrum when he talks about the 2020 election rather than the policies he plans to pursue if he’s elected again, and news of the indictments would add to the uncertainty about the former president’s electability.

“He is going to have to have the middle,” he said. “I don’t see how Trump wins the presidency.”

Dean Cromlish, a state GOP delegate from Gwinnett County in the Atlanta metro region, said he will vote for Trump in the primary, but acknowledged that the legal battles have hurt him. “They are doing everything they can to keep his name negatively in the press,” he said. “They’re trying to keep people from remembering his accomplishments.”

Between drinks at the cigar party, committee members shared reactions from other Republicans crisscrossing social media, with even Trump’s 2024 rivals mostly rushing to his defense. One exception was former Arkansas governor Asa Hutchinson, who is scheduled to speak here on Saturday and on Thursday night called on Trump to quit the race.

“I think Asa should end his campaign, because the biggest crowd he will be around will be here at the convention,” said Salleigh Grubbs, the party chair from Cobb County, northwest of Atlanta.

Kari Lake, the Trump-endorsed Arizona Republican who lost her 2022 bid for governor, was on her way here for a Friday night keynote speech. She logged on to a Twitter chat room where she said she’d spoken with Trump earlier on Thursday night. “And he just said, ‘Kari, I never thought this is what my future would look like,” Lake recalled. “But, but he’s OK with it. He’s OK with taking these hits for us.”

She arrived later at the cigar party wearing a T-shirt with the face of Andrew Breitbart, the late right-wing website founder, and the word “WAR.”

Lake’s keynote replaced former vice president Mike Pence, who withdrew to launch his presidential campaign with his sharpest-yet rebuke of his former running mate, suggesting that Trump’s conduct on Jan. 6, 2021, the day a pro-mob stormed the U.S. Capitol, made him unfit to serve. The home-state governor, Brian Kemp, and secretary of state, Brad Raffensperger, who famously refused Trump’s demands to overturn the 2020 results, will be skipping the convention here.

Instead it will feature long-shot presidential candidate Vivek Ramaswamy, who on Thursday night pledged that if elected he would pardon Trump. Trump’s speech on Saturday will be his first since the indictment, and advisers said he’ll use the occasion to aggressively attack the prosecutors.

“It never hurts him when this kind of thing happens to him because everybody knows it’s politically motivated and not real. It makes him a martyr,” said Jackie Harling, the new party chair in Walker County, in the northwest corner of the state. “He was our voice. Sometimes he was not polished or polite. But he’s actually speaking for us.”

The anger she described was close to the surface for some party activists as they heard the news for the first time.

“Get in line,” Jim Tully, the Paulding County chairman, said when told there was another indictment. “I’m not surprised. Fulton County’s coming next and that’s a sham,” he added, meaning the Atlanta-area district attorney’s investigation into Trump’s pressure on state officials over the 2020 election.

“Don’t start me with that,” said Orien Roy, a Georgia field representative with the right-wing youth group Turning Point Action. “I was just at the county commissioners’ meeting yesterday,” he said, referring to county officials’ rejection of a Republican nominee for the election board who had challenged the eligibility of thousands of voters.

“The American conservative is about to erupt,” Tully said. “We have had enough of being bowled over in our lifestyle, our religious beliefs, our work ethic and our responsibility. This is an attempt to intimidate us.”

Others sounded more sanguine about the potential political fallout for Trump, or lack thereof.

“They keep going after him, it doesn’t change any opinions — good bad or indifferent,” said Mark Williams from Duluth. He was handing out stickers for Ultra Right, a new “100% woke-free American beer” about to ship its first brew in response to conservative backlash against Bud Light’s sponsorship of a transgender TikTok star.

“I think he’s paying people to sue him,” Williams said of Trump. “Every time he’s indicted he goes up in the polls.”

The former vice president, Mike Pence, has again called for the attorney general, Merrick Garland, to unseal the indictment against Donald Trump immediately.

Speaking at a campaign rally in New Hampshire today, Pence called on Garland to “stop hiding” and to “stand up and explain to us why this was necessary before the sun sets today”.

Pence said:
"The American people deserve to know the basis of this unprecedented action. They deserve to know today.
Once the facts and the laws are explained and revealed in full to the American people, we can all make our own judgment."

An aide to Donald Trump, Walt Nauta, has been indicted alongside the former president in special counsel Jack Smith’s investigation into the mishandling of classified documents, according to several reports.

Trump has also posted about the news on Truth Social. He said:

"I have just learned that the “Thugs” from the Department of Injustice will be Indicting a wonderful man, Walt Nauta, a member of the U.S. Navy, who served proudly with me in the White House, retired as Senior Chief, and then transitioned into private life as a personal aide. He has done a fantastic job! They are trying to destroy his life, like the lives of so many others, hoping that he will say bad things about “Trump.” He is strong, brave, and a Great Patriot. The FBI and DOJ are CORRUPT!"

The indictment reads that Trump stored in his boxes “included information regarding defense and weapons capabilities of both the United States and foreign countries; United States nuclear programs; potential vulnerabilities of the United States and its allies to military attack, and plans for possible retaliation in response to a foreign attack.”

It goes on:

The unauthorized disclosure of these classified documents could put at risk the national security of the United States, foreign relations, the safety of the United States military, and human sources and the continued viability of sensitive intelligence collection methods.

The indictment also writes that Trump described a Pentagon “plan of attack” and shared a classified map related to a military operation.

The former president “showed and described a ‘plan of attack’ that Trump said was prepared for him by the Department of Defense and a senior military official” during a meeting at the Trump national golf club in Bedminster, New Jersey, the indictment reads. It says:

Trump told the individuals that the plan was “highly confidential” and “secret”.

The indictment reads that Trump stored classified documents in “a ballroom, a bathroom and shower, an office space, his bedroom, and a storage room” at his Mar-a-Lago resort.
